Acceptance of Terms of Use

The following are Terms of Use of SUPPORTrix Services ("Terms of Use") between SUPPORTrix Services customers ("Customers") and SUPPORTrix. By accessing, browsing, or using www.supportrix.com ("Site"), Customers acknowledge that they have read, understood, and agreed to be bound by these terms and to comply with all applicable laws and regulations. If Customers do not agree to these terms, please do not use this Site.

SUPPORTrix may, without notice to Customers, at any time revise these Terms of Use and any other information contained in this Web site by updating this posting. SUPPORTrix may also make improvements or changes in the products, services, or programs described in this site at any time without notice.


SUPPORTrix Service

SUPPORTrix provides remote support for specific consumer electronics devices such as computers, computer peripherals, software, and any other computer-related products described in the section titled “Supported Products”. SUPPORTrix charges customers a one-time fee based on packages described further in the Services Section

Customers obtain technical support from SUPPORTrix technical support engineers (“SUPPORTRix TSEs”) by contacting them through phone. SUPPORTrix only offers remote technical support. Onsite service is not included in the SUPPORTrix offering.

SUPPORTrix offers customers the option of Remote Access Support, where a SUPPORTrix TSE can, with customers’ permission, take over the customers’ computers from the SUPPORTrix TSE’s remote location. By accepting the Terms of Use, customers acknowledge that they are aware that they will, on occasion, be offered the Remote Access Support option. SUPPORTrix TSEs are not allowed to use Remote Access Support without the explicit consent of the customers.

SUPPORTrix will use reasonable effort to provide customers with technical support, for as long as customers’ accounts are currently active. SUPPORTrix reserves the right to refuse service to anyone.


Bundled Products/Services from Third Parties

SUPPORTrix provides products and services from third parties as part of its SUPPORTrix service. These third party products and services are covered by their respective publishers/owners. SUPPORTrix does not guarantee the usability or merchantability of such products and services.

No Assurance of Problem Resolution

SUPPORTrix will use reasonable effort to resolve the customers' problems. However, the complexity of technology will inevitably result in SUPPORTrix being unable to resolve certain customers' problems. Customers acknowledge that they are aware of this limitation and by subscribing to the SUPPORTrix service have indicated acceptance of the No Assurance of Problem Resolution section of the Terms of Use.

Notwithstanding such limitation, SUPPORTrix does not guarantee problem resolution to any of the customers' problems. SUPPORTrix will only exercise reasonable effort to resolve said customers' technical problems.

Products Supported

SUPPORTrix provides technical support for popular consumer electronics devices and software. Specific products supported are described on the SUPPORTrix website (www.supportrix.com), and are subject to change. Customers acknowledge that due to the rapidly changing nature of technology, SUPPORTrix cannot be held responsible for supporting every consumer's electronics-related product in the market. SUPPORTrix will clearly indicate which products or product lines are supported on the SUPPORTrix website(www.supportrix.com). SUPPORTrix can, at its own sole discretion, decide to provide technical support for a product not listed on the web site. In this case, SUPPORTrix warrants support only for the specific problem instance and does not warrant that it will continue to support such unlisted product beyond the single specific instance described above.

SERVICE PROVIDED VIA THIS WEB SITE IS ON AN "AS IS" BASIS AND SUPPORTrix MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WITH RESPECT TO THE SERVICE. SUPPORTrix DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN ADDITION, SUPPORTrix DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA THE SUPPORTrix's WEB SITE IS ACCURATE, COMPLETE OR CURRENT. SUBSCRIPTION FEE AND AVAILABILITY INFORMATION IS SUBJECT TO CHANGE WITHOUT NOTICE.

Limitation of Liability

IN NO EVENT SHALL SUPPORTrix BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, PUNITIVE, SPECIAL OR OTHER DAMAGES WHATSOEVER RESULTING FROM OR RELATED TO SUPPORTrix's PERFORMANCE OR FAILURE TO PERFORM UNDER THIS TERMS OF USE OR THE FURNISHING, PERFORMANCE OR USE OF ANY SURVICE PROVIDED PURSUANT HERETO, WHETHER DUE TO BREACH OF CONTRACT, BREACH OF WARRANTY, STRICT LIABILITY, PERSONAL INJURY, THE NEGLIGENCE OF SUPPORTrix OR OTHERWISE. SUPPORTrix's LIABILITY SHALL BE LIMITED SOLELY TO THE REPAIR, REPLACEMENT OR CREDIT OF THE SERVICE, AT SUPPORTrix's OPTION.

Indemnity

Customers agree to defend, indemnify and hold SUPPORTrix and its affiliates, and their respective directors, officers, employees and agents, harmless from and against any and all liabilities, costs and expenses, including reasonable attorneys' fees, arising from or in any way relating to their use of SUPPORTrix service due to or arising out of your access to or use of the Site or content on the Site, customers' uploading, emailing, posting, publishing or otherwise transmitting content to any forum or submitting any content to SUPPORTrix, customers' violation of the Terms of Use or any additional rules, guidelines or terms of use posted for a specific area of the Site.

Governing Law

All matters relating to Customers' access to, and use of, the Site shall be governed by laws of the Philippines. Any legal action or proceeding relating to Customers' access to, or use of, the Site shall be instituted in a court in Manila (if the business process will be conducted here), Philippines. Customers and SUPPORTrix agree to submit to the jurisdiction of, and agree that venue is proper in this court in any such legal action or proceeding.

Ownership Rights of Documents and Software

Any document, including graphics incorporated in the documents posted on the Site ("Documents") fall in ownership of SUPPORTrix. The documents may be used by customers solely for personal, informational, non-commercial purposes; and the documents may not be modified or altered by Customers in any way. Except where Customers' use constitutes "fair use" under copyright law, Customers may not otherwise use, download, upload, copy, print, display, perform, reproduce, publish, license, post, transmit or distribute any documents or other content from the Site in whole or in part without the express authorization of SUPPORTrix.

Any software and accompanying documentation Customers are provided, download or access through the Site ("Software") is the copyrighted work of SUPPORTrix and/or a third party software provider. Customers' use, reproduction or redistribution of the Software is prohibited. Except where expressly provided otherwise, all Software is provided on an "as is" basis, and SUPPORTrix expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Termination or Suspension of Service

Upon Customers' breach any content of the Terms of Use, SUPPORTrix shall be entitled to terminate or suspend Customers' service solely at its own discretion, without consulting Customers. SUPPORTrix shall incur no liability resulting from terminating or suspending service upon breach by Customers.

Refund Policy

SUPPORTrix shall not be obligated to refund Customers whatsoever for Customers' required service on the basis of per incident.

Customers who subscribe to any SUPPORTrix package (excluding Starter Package - per incident) can choose to unsubscribe within 15 days of subscribing.

Except otherwise provided in the Refund Policy, under the condition that SUPPORTrix has not provided any service, SUPPORTrix offers a refund of maximum of 100% of the price paid by Customers, Provided that certain service has been provided, SUPPORTrix will deduct an amount which is proportionate to the service of incident(s) which has been provided and refund the balance to Customers within 30 days of receiving the request for unsubscribing. The price for any package (excluding Per Incident Package) shall be divided by the number of incidents included in the package. In addition, as long as any service has been provided for any incident(s) included in any package, no matter the incident has been completely resolved or not, SUPPORTrix shall be entitled to retain the total amount of price which covers the incident(s).

Customers' accounts will become inactive once their requests for unsubscribing are received. Refund will be credited to the credit card account provided by Customers at the time of subscribing. Refund Policy is subject to change and the latest policy will be applicable at the time of issuance. To unsubscribe, call 1-877-787-8749. SUPPORTrix customer service representatives will attend to and process the request.
